新时期,随着我国市场经济体系的逐渐成熟与改革开放的深入推进,人们的思想文化观念发生了巨大改变。随之,在我国政治、经济及社会深入改革的大潮推动下,人权思潮理念逐渐走进我们的视角并逐渐深入人心。在21世纪的“人权”背景下,我国的政治经济社会等诸方面都在发生着改变以适应时代发展的要求,其中,法律制度作为社会经济生活发展的保障,亦是如此,而其中,新时期的民诉法便迎来了革新的挑战。本文主要立足于此,对大背景下的民诉法修改进行一定地思考。
In the new era, with the gradual maturity of the market economy system in our country and the deepening of reform and opening up, great changes have taken place in people’s ideological and cultural concepts. Following this, driven by the tide of political, economic and social reform in our country, the concept of the trend of human rights ideology has gradually entered into our perspective and has gradually gained popular support. Under the background of “human rights” in the 21st century, all aspects of our country’s political economy and society are undergoing changes in order to meet the requirements of the development of the times. The legal system, as the guarantee for the development of social and economic life, is also the case in which Civil Procedure Law of the new era ushered in the challenge of reform. This article mainly based on this, some thinking on the revision of Civil Procedure Law in the background.
