目前,在港口散货作业业务活动中,作业委托方与港口经营人之间所签订的委托作业合同存在着形式不统一、内容简繁各异、主要条款不完备等问题。这些问题的存在,使港口企业在合同履行过程中往往遭受了不应有的经济损失。为维护港口企业的合法权益,中国港口协会结合港口散货委托作业的特点,经组织相关专家学者反复研究,广泛征求意见,拟制了《港口散货委托作业合同(推荐文本)》。这一文本宣告了中国港口企业首次有了一个统一的比较完备的作业合同文本。下文随记反映了合同文本诞生的整个过程。读之一定会感到它既来之不易又意义重大,望各港重视之、并努力推行之。 At present, there are some problems such as the inconsistent form, inconsistency in content, and incomplete main provisions in the contract for entrusted operation signed between the operator and the port operator in the bulk cargo operations at the port. The existence of these problems makes the port enterprises often suffer undue economic losses during the contract performance. In order to safeguard the legitimate rights and interests of port enterprises, China Port Association has consulted relevant experts and scholars repeatedly and consulted extensively on the basis of the characteristics of port bulk cargo entrusted operations and drafted the “Port Bulk Contract (Recommended Text)”. This text proclaims for the first time that China’s port enterprises have a unified and relatively complete copy of the contract of operation. The following text reflects the whole process of the birth of the contract text. One of them will surely feel that it is both hard-earned and of great significance. It is hoped that Hong Kong will attach importance to it and work hard to promote it.
