我国政府一贯坚持尊重和保护罪犯的人权。《中国改造罪犯的状况》白皮书全面归纳和总结了我国政府和司法机关保护罪犯的人权政策、原则和方法,阐明了我国在保障罪犯人权问题上立场和观点。《宪法》以及《刑事诉讼法》先后对“尊重和保障人权”的问题作出原则规定。监所检察工作是检察机关对刑事诉讼活动进行法律监督的最后环节,肩负着保障刑罚统一正确执行、维护监管场所秩序、促进司法公平公正等法律监督职责。为了解决所面临的一系列问题以及推进监所检察的科学发展,必须以尊重和保护人权这一宪法的原则以及刑事诉讼法的基本任务为宗旨,同时改变传统的以重罚为指导思想、以强制劳动改造为手段、以人格歧视为思维习惯的司法观念和价值取向,坚持宪政人文关怀的价值取向和时代精神。
