金融消费者立法旨在保护接受金融产品或服务的弱势群体,因此,金融消费者的外延不易过窄地将投资者排除在外,弱势投资者可以通过拟制技术视为消费者。金融消费者保护的核心是为其提供倾斜法律保护,关键则在于设立以保护消费者利益为己任的独立监管机构,对金融经营者实施消费者保护合规监管,创新争议解决机制,从而体现实质公正的价值理念。
Financial consumer legislation aims to protect disadvantaged groups that accept financial products or services. Therefore, the extension of financial consumers is not easily narrowed to exclude investors, and disadvantaged investors can be regarded as consumers through fictional technology. The core of financial consumer protection is to provide it with legal protection.
