民告官的难题,诸多学者至今还在不断地探索。25年前,姜明安大学毕业时执拗地回答老师龚祥瑞先生:“没有土壤我们可以改造啊!”当时姜明安选择了行政法研究,却被他的老师龚祥瑞先生兜头泼了一盆冷水。老师告诉他,中国没有搞行政法的土壤,到时“你吃饭都会成问题”。姜明安坚持走了下来,如今,他不存在“吃饭的”问题,他认为《行政诉讼法》还存在很多问题,但比20多年前进步多了。1989年通过《行政诉讼法》前后,其时的姜明安切身体会到了龚祥瑞的忧虑——“民告官”在中国之难。姜明安教授已经从事20多年行政法研究,他接受了《民主与法制时报》记者的采访,谈了对中国行政诉讼法的进程和面临的问题的一些看法。
