普通法传统是一种使英国法制度在历史上有别于欧洲大陆的罗马——日耳曼法律制度的法律类型和立法模式。普通法是一套不断演进的法则,是在对无数个案作出法律裁判的基础上日积月累形成的。因为这些原则都包含在具体的判例中,所以这些原则都特别具有针对性,都不至于过于笼统。相反,大陆法系则总是带有一种经院的味道——是文艺复兴时期的学者在复兴罗马法的基础上发展起来的。[1]普通法传统的代代相传,使得当代的普通法不再是无源之水、无本之木;普通法传统的内在精神的驱使和鞭策,使得当代的普通法国家能够较为恰当地平衡好法律的灵活性与稳定性之间的关系。
The common law tradition is a legal type and legislative model of the Roman-German legal system that historically distinguished the British legal system from continental Europe.
