劳动报酬来源的依赖性决定了劳动者与用人单位的地位不可能平等。为了保证双方的关系不至于过度失衡,立法上采取了对劳动者的倾斜性保护,司法上采取了合理的举证责任的分担。在现实中,用人单位侵害劳动者权利的情形时有发生,劳动者不应茫然不知所措;经验告诉我们,面对非法侵害,法律是保护劳动者自己权利的最好武器。在此,笔者列举了劳动者的主要法定权利,并提出相应的维权建议,以期对广大读者有所帮助。
