职务犯罪是指国家工作人员利用职务上的便利条件,以权谋私、滥用职权或者不正确履行职权所实施的违背职责要求,损害公众对于政府的信赖感,依法应受刑事处罚的行为的总称。就交通部门而言,交通行政执法涵盖路政、运政、航道、海事、规费征收等多方面,涉及面广,社会关注度高。本文结合当前交通执法工作实际,就交通行政执法人员职务犯罪的特点、成因及预防试作探讨。
Duty crime refers to the general name of behavior that state staff should be subject to criminal punishment according to the law if they use the convenience conditions of their positions, abuse of their powers, abuse of power, or improper performance of their duties to violate the requirements of their duties, undermine the public’s trust in the government. As far as the transport sector is concerned, traffic administrative law enforcement covers many aspects such as administration of the road, administration of the economy, waterway, maritime affairs, collection of fees and so on. It covers a wide range of areas and has a high social attention. Based on the actual traffic law enforcement work, this article discusses the characteristics, causes and prevention trials of job-related crimes committed by traffic law enforcement officers.
