《招标投标法》和《政府采购法》都是调整公共采购与政府采购的基本法。由于《招标投标法》调整的主要范围是公共采购及其招标投标行为,《政府采购法》调整的范围是传统政府采购,因此,两法都是共同调整公共采购和传统政府采购的基本法。但鉴于《招标投标法》已对公共采购的招标投标程序规则作了具体而翔实的规定,并适用于在中华人民共和国境内进行的一切招标 The “Tendering and Bidding Law” and the “Government Procurement Law” are the basic laws governing public procurement and government procurement.
