2000年11月24日,又一起新闻官司在福建省泉州市落下推幕。作为被告的《海峡都市报》再次告败。自1983年1月,我国第一起新闻官司《二十年“疯女”之谜》到1994年总共180起新闻官司中,绝大部分是以新闻界败诉而告终。此例只不过是近年来诸多败诉案件中的一例。究竟是什么原因使新闻界在新闻官司中败多胜少?本文拟从该新闻官司作个案分析起,并试图从新闻学、大众传播学与法学的交汇点对这一现象的因源作粗浅探索。
On November 24, 2000, another news agency filed a curtain in Quanzhou City, Fujian Province. The Strait Metropolis, the defendant, again failed. Since January 1983, China’s first news lawsuit, “the mystery of two decades of crazy women,” reached a total of 180 lawsuits by the end of 1994, with the overwhelming majority ending in the losing of the media.
