在我国,根据《中华人民共和国行政诉讼法》第五十条规定,人民法院审理行政案件,不适用调解。但是,司法实践经验的积累、法学理论的研究、社会主义和谐社会理念的发展促使人们对人民法院审理行政案件的这一原则进行反思。行政诉讼和解基于行政案件的特殊性,既不同于民事诉讼和解,又不同于行政调解,是由三方参与的解决行政案件的司法方法。中国传统文化、和谐社会理念、行政自由裁量权是行政诉讼和解的理论基础。
In our country, according to Article 50 of the “Administrative Procedure Law of the People’s Republic of China”, people’s courts do not apply mediation when handling administrative cases. However, the accumulation of experience in judicial practice, the study of jurisprudence and the development of the concept of a harmonious socialist society have prompted people to reflect on the principle that people’s courts should try administrative cases. Administrative litigation reconciliation based on the particularity of administrative cases is not only different from civil litigation settlement, but also different from administrative mediation. It is a judicial method to solve administrative cases involving three parties. Chinese traditional culture, the concept of a harmonious society, administrative discretion is the theoretical basis for the settlement of administrative litigation.
