人权,是每个人都应该享有的一项基本权利。它是指在一定的社会历史条件下,以个人的本质和尊严为参照而享有的相应的权利,它注重人的生存和发展,以自由和平等作为本质特征。尊重和保障人权是民主政治的基本要求,也是社会政治文明的基本标志。我国的人权保障事业经历了一个漫长而艰辛的探索过程,近些年来,随着我国司法制度的不断完善以及司法机制改革步伐的加快,我国的人权保障工作取得了突破性的进展。2012年修正的新刑诉法把“尊重和保障人权”写入了总则中,并将尊重和保障人权的具体做法详细化并入法律条文当中,真正意义上地使得人权有了法律依靠和保障,实现了保障人权与惩罚并重。本文将从介绍新刑诉法修正情况入手,叙述新刑诉法中关于被害人权益保护的创新点,之后在提出新刑诉法中对于被害人权益保护的不足之处,最后再提出完善被害人权益保护机制的几条措施。
Human rights is a basic right everyone should enjoy. It refers to the corresponding rights enjoyed under certain historical and social conditions with reference to the essence and dignity of the individual. It focuses on the survival and development of human beings and regards freedom and equality as essential features. Respecting and safeguarding human rights is the basic requirement of democratic politics and the basic symbol of social and political civilization. Our country’s human rights protection undertaking has experienced a long and arduous exploration process. In recent years, with the constant improvement of the judicial system in our country and the acceleration of the reform of the judicial system, China’s human rights protection has made a breakthrough. The new Criminal Procedure Law, amended in 2012, included “General Principles on Respect and Guarantee of Human Rights” and incorporated details of the specific practices of respecting and safeguarding human rights into legal provisions, which truly brought human rights into law And safeguarding, so as to ensure equal protection of human rights and punishment. This article starts with the introduction of the amendment of the new Criminal Procedure Law, describes the innovation of the new Criminal Procedure Law on the protection of victims ’rights and interests, and then puts forward the protection of victims’ rights and interests in the new Criminal Procedure Law.
