结合基层信访治理困境和国家政治行政运行,分析信访制度的运行过程和功能定位。把信访案件分为政策在位型信访、政策缺位型信访和无理型信访,将信访制度的功能分为国家意志表达的政治功能和国家意志执行的行政功能。不同类型信访案件处理过程中,信访功能定位的侧重点有差异。政策在位型信访和政策缺位型信访是当前信访案件中的主流,无理型信访是信访案件中的支流。信访制度法治化改革中的主要矛盾在于,如何有效应对政策在位型信访和政策缺位型信访,以此为基础理顺信访的政治功能和行政功能,探寻法治化改革路径,适应国家与社会关系的新变化。
