本文从四个方面,即依据混淆理论的保护、依据淡化理论的保护、企业名称与驰名商标、驰名商标的效力,比较了中日两国有关驰名商标保护的法律规定和实践。根据本文的研究,在驰名商标的保护方面,日本有一系列做法值得中国学习。例如,日本将企业名称分为“名称”的方面和“财产权”的方面,对于中国重新定位企业名称,处理企业名称与驰名商标的关系,具有极大的启发意义。又如,日本的理论界和实务界普遍认为,认定驰名商标是为了解决个案的争端,其效力仅限于本案,与广告宣传等超出个案的事项没有任何关系。这对于中国重新认识驰名商标的含义和驰名商标保护的目的,具有积极的借鉴意义。除此之外,日本允许法院在诉讼中直接宣告注册商标无效,以及既在商标法中又在反不正当竞争法中提供对于驰名商标的反淡化保护,也值得中国的立法机关借鉴。
This article compares the legal provisions and practices on the protection of well-known trademarks in China and Japan from four aspects, namely, the protection based on confusion theory, the protection based on desalination theory, the enterprise name, the effectiveness of well-known trademarks and well-known trademarks. According to the research in this article, Japan has a series of practices worthy of studying in China on the protection of well-known trademarks. Japan, for example, divides its name into “name” and “property rights”, which is of great enlightenment to China in repositioning its business name and handling the relationship between its name and well-known trademark. In another example, Japan’s theoreticians and practitioners generally agree that the recognition of a well-known trademark is to resolve individual case disputes and its effectiveness is limited to this case. It has no bearing on matters beyond the scope of advertising. This has a positive reference for China to re-understand the meaning of well-known trademarks and the protection of well-known trademarks. In addition, Japan allows the court to directly declare the invalidation of a registered trademark in a lawsuit, as well as to provide anti-dilution protection of well-known trademarks both in the Trademark Law and in the Unfair Competition Law, and also worth learning from the Chinese legislature.
