当前我国电信行业仍呈现独家垄断或者寡头垄断的局面,使得电信行业的有效竞争无法得到实现。要打破这种垄断局面,仅靠市场经济的自我调节是不够的,更重要的是要由政府从宏观上对电信行业进行监管,运用法律手段对经营者的垄断行为进行规制。本文在对我国电信行业的垄断现状进行分析的基础上,进一步探讨该行业反垄断规制中存在的问题,以期对我国电信行业经营者行为的反垄断法规制提供建议。
At present, China’s telecommunications industry is still showing an exclusive monopoly or oligopoly situation, making the effective competition in the telecommunications industry can not be achieved. To break this monopoly situation, self-regulation by the market economy alone is not enough. More importantly, the government should supervise the telecommunications industry from a macro perspective and use legal means to regulate the monopoly of operators. Based on the analysis of the current situation of the monopolization of telecom industry in our country, this article further explores the problems existing in the antitrust regulation of the industry in order to provide suggestions on the antitrust rules and regulations of the telecom operators in China.
