由于商标具有消除消费者和经营者两者之间有关产品信息差异的作用,消费者对商品产生购买的心理基础就是对商标的认知程度,商标法立法的主要目的就是保护消费者的合法权益,消费者对于商标的知名度的判定具有非常重要的作用,消费者混淆商标的可能性则是产生侵权的主要方面。因此,在商标法中消费者权益的保护是其主要的立法目的,而且也是其设立的主要中心点。
