从形式、内容、主体、时间等四个维度检视湖南省935个行政裁量基准文本,可以梳理当下裁量基准制定运动中普遍存在的名称混乱、内容重复、效力冲突、技术有限等突出问题。裁量基准制定中的泡沫化现象不仅浪费了有限的社会资源,而且消解了裁量基准应有的控制功能,应当引起行政法学理和实务部门的高度警惕。为了摆脱行政裁量基准制定的困境,科学配置不同行政机关之间的基准制定权限和推行上下互动的基准生成模式是今后重要的努力方向。
This paper examines 935 administrative discretionary benchmark texts in Hunan province from the four dimensions of form, content, subject, time and so on. It can sort out the prominent problems such as confusion of name, repetition of content, conflict of effectiveness and limited technique that are common in the current drafting exercise. The bubble phenomenon in the formulation of the discretional benchmarks not only wastes the limited social resources, but also eliminates the control functions that the discretionary bases should have, which should arouse the vigilance of the administrative law and the substantive departments. In order to get rid of the predicament of making administrative discretion basis, it is an important direction for the future to scientifically allocate the authority for benchmarking between different administrative organs and to promote a benchmarking model that can interact with each other.
