理论的研究起点是每个理论构建其体系的开端。市场缺陷作为国家调节说的研究起点,决定着该理论的内容边界、逻辑框架和思考进路。市场缺陷是经济学市场失灵理论体系中对市场功能失灵的原因概括,其内涵和外延随着经济发展和社会变迁而逐渐拓宽。国家调节说在借鉴经济学研究成果的基础上,基于经济法学研究的基本任务,将研究重心落实于市场失灵的原因即市场缺陷。通过包括分类研究在内的各种研究,确定了国家调节经济的方式以及经济法的内容和体系。这一研究起点预设了国家调节相对于市场调节的第二性,也包含了对国家能力的潜在追问,从而厘定了研究框架和思考进路,反映了理论建构者的深刻意图。市场缺陷本质上反映了社会对国家经济职能的需求,这表明市场缺陷内容的开放性。基于研究起点的开放性,国家调节说的内容和体系也必然是随之不断发展。“国家调节说”最重要的价值,正是在于通过科学地界定研究起点而获取了一个开放性的视角,一个科学的思考问题的框架,从而奠定了经济法学研究的基础,为今后的研究指明了方向。
The starting point of theoretical research is the beginning of each theory to construct its system. As a starting point for the study of state regulation, market imperfections determine the content boundary, logical framework and thinking path of the theory. Market imperfection is the reason for the failure of market function in the theoretical system of economic market failure. Its connotation and extension gradually widen with the economic development and social changes. On the basis of learning from the economic research results and based on the basic tasks of economic law study, the state regulation said that the study should focus on the causes of market failure, namely, the market defects. Through a variety of studies including classification studies, the modalities of state regulation of economy and the content and system of economic law have been identified. The starting point of this study presupposes the second nature of state regulation relative to market regulation and also the potential questioning of national capabilities, thus determining the research framework and thinking path, which reflects the profound intention of theoretical constructors. Market imperfections essentially reflect the society’s demand for the country’s economic functions, indicating the openness of market-defective content. Based on the openness of the research starting point, the content and system of state regulation must also continue to evolve. The most important value of “national regulation theory” lies precisely in obtaining an open perspective and a framework of scientific thinking problems by scientifically defining the research starting point, laying the foundation for the study of economic law. Research indicates the direction.
