20世纪初,德国法学家把一种新的法律现象概括为经济法,并把它作为专门的法学研究对象,标志着一个新兴的法律部门的诞生。然而,在将近一个世纪的时间里,法学家们虽然一致认为,经济法确实是存在着的,但对其根本理论和目标,对经济法是什么,却没有统一的见解。本文试从其中的因果关系作一简略的探讨,并由此回答经济法是什么。 At the beginning of the 20th century, German jurists summarized a new legal phenomenon as economic law and regarded it as a special object of law study, marking the birth of an emerging legal department. However, for nearly a century, though jurists agree that economic law does exist, there is no unified opinion about its fundamental theory and objective and its economic law. This paper tries to make a brief discussion of the causal relationship among them and answer the question of economic law.
