遵循先例原则是英美法中最重要的原则之一,它是英美法在技术操作层面的“帝王原则”.作为一种法律制度中举足轻重的原则,其存在、发展的本身就表示了一种生命力.这种生命力应该不仅仅源于其作为具体法律操作中所遵循的技术性规则的一部分,更应该有其制度层面的架构反映以及文化深层的惯性作用.源于令状的制度架构以及沁入文化深处的法律至上观念,从根本上诠释了遵循先例原则的内涵.遵循先例原则对我国的法制建设有借鉴意义.
