在林权遭到破坏,森林资源得不到有效保护的情况下,贵州省龙山村的集体林权改革根本不可能取得预期成效,集体山林仍然无法摆脱被毁灭的命运。探讨了山林毁灭的原因及后果,认为通过改革真正明晰产权,依法加强对林权的保障,是集体林权改革成功的基础。同时,林权改革必须考虑森林的公共福利性质,结合各地实际情况选择适当的改革方式。 Under the circumstance where the forest rights were destroyed and the forest resources were not effectively protected, the reform of the collective forest rights in Longshan Village, Guizhou Province could not achieve the expected results at all and the collective forests were still unable to get rid of the fate of being destroyed. The causes and consequences of the destruction of the forest were discussed. It is believed that through the reform, the real right of property is clarified and the protection of the forest rights according to law is the basis of the success of the reform. At the same time, the reform of forest tenure must consider the nature of the public welfare of forests and select appropriate ways of reform in light of the actual conditions in various places.
