谷歌公司提出建立数字图书馆计划,在版权世界里一石激起千层浪。赞成者认为这将实现人类最伟大的一个梦想,而反对者则声称这会摧毁整个文化创意产业。但不管数字图书馆计划能否成功,它都对现今法律当中的版权概念提出了严峻的挑战,逼得我们不得不反思:到底是谷歌之过,还是版权法之过?通过追溯版权制度的本源便可发现,版权的概念并非是一成不变的,数字时代的版权也应该与时俱进。
Google proposed the establishment of a digital library project, in the copyright world a ripple. Proponents believe this will accomplish one of the greatest human dreams, while opponents claim it will destroy the entire cultural and creative industries. However, regardless of the success of the digital library project, it poses a serious challenge to the concept of copyright in current law, forcing us to reflect on whether Google is the past or the copyright law? By tracing the origin of the copyright system We can see that the concept of copyright is not static and that the copyright in the digital age should also keep pace with the times.
