我国法律对预售商品房再转让制度至今没有明确规定。本文运用民法原理和合同法的有关规定,借鉴国外的经验,认为我国不应该一律禁止预售商品房的再转让制度,并提出了适用这一制度的条件和几点立法建议。
China’s law on the pre-sale real estate re-transfer system so far no clear rules. This article uses the relevant provisions of the Civil Law Principle and the Contract Law and draws lessons from the experience of other countries for reference. It holds that China should not prohibit any re-assignment of the pre-sale housing system and proposes the conditions and legislative suggestions for applying this system.
