我国新《商标法》的修改成功确立了声音商标的注册性,将非传统声音商标纳入法律的保护范畴。由于声音标志具有抽象性、动态性等特点,我国在声音商标注册领域程序要件尚不明确,对商标的注册审查带来一定难度。本文借鉴各国已有立法,为我国声音商标注册程序审查标准的设立提出建议。
The revision of the new “Trademark Law” in our country has successfully established the registration of sound marks and incorporated non-traditional sound marks into the protection of law. Due to the abstract and dynamic characteristics of the sound signs, the procedural requirements of our country in the field of sound trademark registration are not yet clear, which brings some difficulties to the registration examination of trademarks. This article draws on the existing legislation in various countries, to make recommendations for the establishment of the review standard for the registration procedure of sound trademark in China.
