本文首先论述了20世纪80年代以来政治风险担保对促进外国投资流向发展中国家(包括中国)的重要现实意义以及MIGA在其间所起的特殊作用。接着对MIGA晚近发展的各个方面,诸如担保业务的扩大、环保考虑、纠纷解决以及技术援助活动等,作了相当系统的论述和分析,阐明了MIGA的新世纪战略以及该机构为之所做的努力。尤其是专门剖析了过去十几年里MIGA在华开展担保业务有起有落的原因,并回答了中国国内一些学者由此而产生的疑问。文中特别对MIGA参与处理的一起有关中国的投资担保纠纷案作了比较详细的评析。
This article first discusses the important practical significance of political risk guarantee to promote the flow of foreign investment to developing countries (including China) since the 1980s and the special role played by MIGA in the meantime. It then goes through a fairly systematic exposition and analysis of various aspects of MIGA’s recent development, such as the expansion of secured operations, environmental considerations, dispute resolution and technical assistance activities, illustrating MIGA’s strategy for the new millennium and what the agency did for it Work hard. In particular, I analyzed in detail the reasons why MIGA started to carry out guarantee business in China in the past ten years and answered questions raised by some scholars in China. The text specifically deals with a case of dispute over China’s investment guarantee that MIGA participated in to deal with in more detail.
