案例彭林想在北京买房,因无购房资格找堂兄彭岩想办法。彭岩是北京人,于2007年9月购买了一套经适房。该房一直闲置,彭岩同意将此房出售给彭林,但表示无法办理产权登记。彭林表示都是亲戚,无须在意。二人于2008年1月签订《北京市存量房屋买卖合同》。合同约定,彭岩将该房屋出售给彭林,成交价款为42万元。彭林于2008年3月一次性支付了房款,随后又花20万元进行了装修。2009年5月,两人发生矛盾。彭岩遂诉至法院,请求判定之前签订的《北京市存量房屋买卖合同》无效,彭林腾退房屋,恢复原貌。彭林提出反诉,
