中加双边投资条约是中国迄今为止缔结的内容最为广泛的一个双边投资条约,并在重大问题上反映了国际投资协定的新发展和新趋势。加拿大哈顿教授对中加双边投资条约所作的评论,充分体现了他极强的法律意识,是一种敢于向联邦政府谏言的“书生”精神,更是一种忧国忧民的忧患意识和爱国情怀。本文对哈顿教授的忧患意识进行梳理,并对中国以往签订的部分双边投资条约进行反思和借鉴,最后以中国海洋石油总公司收购加拿大尼克森公司案为视角,剖析哈顿教授忧患意识的局限性,批评加拿大某些政党、媒体的不当言论,指出:不要因为害怕中国大规模向加拿大投资的互利共赢行动,就不分青红皂白地喊“狼来了”。
