上海判决短信息纠纷案 日前,上海市卢湾区人民法院一审判决的一案足以引起网络公司的注意。这是一起由乱发垃圾信息引起的纠纷案。据原告卢某诉称,自去年3月起他连续不断收到上海际达网络技术有限公司发到其手机上的短信息,他被这些不期而至的无聊短信息搅得不得安宁。不仅如此,际达公司还从去年9月起向其收取信息费。他起诉要求被告际达公司停止干扰,赔偿损失。经法院查明,被告际达公司曾委托其他单位发展短信息用户,而受委托单位的员工为扩大用户,竟冒用了原告的姓名定制短信息。于是,际达公司按定制单每天向原告发送短信息,并向其收取信息费。法院认为,际达公司未仔细审核定制单,致使原告被动接受短信服务并支付信息费,被告侵害了原告的生活安宁及
