法律职业定位与职业伦理教育是两个相关联的问题。上个世纪九十年代至今,学术界的主流观点是要强调职业人与大众的分野,法学教育上也在强调职业伦理与大众伦理的分殊化。然而,新近的形势表明,更为全面的职业定位,需要综合职业化、大众化以及商业化三个维度。法学职业伦理教育方面,则需要侧重于道德推理能力的培养而非知识点的识记,引导法科生学会在价值冲突之中寻求正义。
Legal career positioning and ethical education are two related issues. From the 1990s to the present, the mainstream view of academia is to emphasize the distinction between professionals and the general public. Legal education emphasizes the diversification of professional ethics and public ethics. However, the recent situation shows that a more comprehensive orientation of the profession requires the integration of three dimensions: professionalization, popularization and commercialization. In law ethics education, we need to focus on the cultivation of moral reasoning ability rather than the recognition of knowledge points, and guide the law students to seek justice in the conflict of values.
