经济法是否具有独立的法律责任,一直是法学理论界争论的焦点。本文从法理学的角度入手,分析了法律责任的基本概念,并指出为了正确地界定经济法的法律责任,还必须正确区分法律责任和法律责任的承担方式这两个不同的法律概念。文章接下来以区分不同法律责任的标准为依据,论证了经济法具有独立的法律责任,最后文章阐述了经济法的法律责任的基本特点和几种特殊的经济法责任承担方式。
Whether economic law has independent legal responsibility has always been the focus of debates in jurisprudence and theorists. From the perspective of jurisprudence, this paper analyzes the basic concepts of legal liability and points out that in order to correctly define the legal responsibilities of economic law, we must also correctly distinguish the two different legal concepts of legal liability and legal liability. Based on the criteria of distinguishing different legal responsibilities, the article demonstrates that economic law has independent legal responsibility. Finally, the article elaborates the basic characteristics of legal liability of economic law and several special forms of responsibility of economic law.
