多元化纠纷解决机制之间存在着复杂的关系,并不能简单的以“司法中心结构”的纠纷解决模式来概括。从镶嵌的视角来看,不同的纠纷解决方式都处在特定的社会结构之中,受相应的社会结构因素的影响。一种纠纷解决方式是否有效,取决于所处的社会结构,如果能够很好的满足其所镶嵌的多方社会利益的均衡需求,一种纠纷解决方式就会得到群体和群体成员的认同和服从,才能够产生解决纠纷、恢复社会秩序、重建人际关系的作用。
There is a complicated relationship between pluralism dispute resolution mechanisms and it can not be simply summed up as a dispute settlement mode of “judicial center structure.” From the mosaic point of view, different ways of dispute resolution are in a particular social structure, affected by the corresponding social structure. Whether a dispute resolution method is effective depends on the social structure in which it is located. If a dispute settlement method is well met by the balanced needs of the multi-stakeholder society in which it is embedded, a dispute resolution method will be recognized and obeyed by the group members and the group members. Can we have the effect of settling disputes, restoring social order and rebuilding relationships.
