保险利益是保险合同的效力要件。“无保险利益者无保险”是一个基本法谚。保险利益原则的规定能够消除赌博的可能性,能够防止道德危险的发生,并且限制了赔偿程度。它是构建起整个保险制度的坚固基石。对于保险利益应存在于何人,立法上较为统一。我国保险法第11条规定:投保人对保险标的不具有保险利益的,保险合同无效。但在学术上却有不同的观点。笔者认为,投保人具有保险利益不是保险合同的生效条件,在财产保险中被保险人应具有保险利益,而人身保险中受益人应具有保险利益。因此,《保险法》第11条的规定有修正的必要。
Insurance benefits are the elements of an insurance contract. “Uninsured without insurance” is a basic proverb. The provisions of the principle of insurance benefits can eliminate the possibility of gambling, prevent moral hazard and limit the degree of compensation. It is a solid foundation for building the entire insurance system. For insurance interests should exist in which people, legislation is more uniform. Article 11 of China’s Insurance Law stipulates: If the insured does not have the insurance interest in the subject matter of the insurance, the insurance contract is invalid. However, there are different academic points of view. The author believes that the insured person with insurance benefits is not the conditions for the validity of the insurance contract, the insured person in the property insurance should have insurance benefits, while the life insurance beneficiaries should have insurance benefits. Therefore, the provisions of Article 11 of the Insurance Law are necessary for amendment.
