本文对影片《马背上的法庭》进行了解读。影片所叙述的故事展示了基层法官的智慧与敬业精神,但更重要的是指出了送法下乡服务于现代民族国家建设的政治使命,以及现代法治意识形态与中国基层司法实践之间的冲突和征服,这种冲突与征服根本上来自于客观的社会变迁。影片揭示了法治意识形态存在的问题,但同时其本身也是法治意识形态取得胜利的一个体现。在中国的法治建设中,始终应当重视中国国情与实践。
This article explains the film Court on Horseback. The story described in the film shows the wisdom and dedication of grass-roots judges. But more importantly, it points out the political mission of sending law to serve the country in the construction of the modern nation-state and the conflict between the modern ideology of law and that of grassroots judicial practice in China. And conquest, this kind of conflict and conquest basically comes from objective social changes. The film reveals the existence of the rule of law ideological problems, but at the same time itself is an embodiment of the triumph of the rule of law ideology. In the course of building the rule of law in China, we must always attach importance to China’s national conditions and practice.
