第十一届全国人大常委会十四次会议表决通过了关于修改国家赔偿法的决定,这次修法最重要的亮点是对“精神损害抚慰金”作了明确规定。据悉,新的国家赔偿法将于2010年12月1日施行。至此,关于国家赔偿中应不应包括精神损害赔偿的争议终于可以尘埃落定了,然而我们发现修改后的《国家赔偿法》对精神损害赔偿的规定是远不够具体清晰,本文拟就国家赔偿中的精神损害赔偿责任的构成要件、赔偿标准以及赔偿金的支付等进行一下浅略的分析。
The 14th meeting of the 11th NPC Standing Committee voted to pass the resolution on the amendment of the State Compensation Law.
