本文全面分析了我国劳动法对劳动合同无效制度规定的现状以及发展市场经济对完善劳动合同无效制度的迫切需要 ,同时笔者对于劳动合同无效的确认标准、现实社会订立劳动合同时的一些不规范情况的效力认定及法律后果的处理提出了建设性意见。以期在保护劳动者合法权益的同时 ,在用人单位与劳动者之间找到最佳的平衡点 ,实现劳动力市场的良性运作。
