我国古代就有从政者异地为官的传统,现阶段《公务员法》对此仍有相关的规定。公务员的任职回避制度是对公务员是否可以具体就职某项工作职位而进行调节和确认重要手段,其本身对于公务员的管理,工作效率,工作方式等方面都具有极大的推动作用,然而该制度在执行过程中却出现了轻视回避制度、回避的范围过窄、相关法律制度不完善,缺乏监督与救济等问题,因而急需改善和完善。本文将采用逻辑分析的方法,分析现阶段这些问题存在的原因,并提出从思想上重视、扩大回避的范围、健全相应的法律规范,完善救济与监督等解决方法,使公务员任职回避制度有一定的进步。
In ancient China, there were traditions in which politicians were off-site officials. At this stage, the Civil Service Law still has relevant provisions. The civil service appointment avoidance system is an important means to regulate and confirm whether a civil servant can take up a specific job or not. This system has a great promotion effect on civil servants’ management, working efficiency and working methods. However, In the process of implementation, the system of disregard of avoidance, the narrow scope of avoidance, the imperfect legal system, the lack of supervision and relief, etc., are in urgent need of improvement and improvement. This article will use the method of logical analysis to analyze the reasons for the existence of these problems at the present stage and put forward that ideological emphasis should be given to expand the scope of avoidance, to improve the corresponding legal norms and to improve the remedies such as relief and supervision, improvement.
