本文将20世纪50年代至21世纪前10年藏族“赔命价”习惯法在青海藏区民间的适用分为三个时期,通过对这三个时期的藏族“赔命价”习惯法在藏区的沿用、被贬抑、在民间社会中的回复适用、到公权力对刑事损害中的民事赔偿部分不予干预的历史予以回溯描述,说明藏族“赔命价”习惯法在藏区社会纠纷解决中的规则意义和作用,进而说明法律生成和成长于社会中,国家法必须对在社会中生成和发展的法律予以尊重和沟通。
This article divides the application of the Tibetan customary law of “compensation for the cost of life” in the first 10 years of the 20th century from the 1950s to the 21st century into three periods in the Tibetan areas of Qinghai Province. By analyzing the Tibetan “compensation for the price of life” in these three periods, Customary law is used in Tibetan areas, depreciated, applied in civil society, and backtracked to the history that public power does not intervene in the civil compensation part of criminal damage, which shows that the Tibetan people ’ The significance and role of the rules in the settlement of social disputes in Tibetan areas, and thus the emergence and growth of law in society, must be respected and communicated by laws of national law that are created and developed in society.
