刑事非法证据排除规则的构建不仅是保障人权的需要,更是是实现司法公正及推进侦查工作改革、打击犯罪的需要。就非法证据排除规则的完善措施而言,还应进一步完善侦查人员出庭的制度与程序规定;增加对初查证据的审查与认定;建立侦羁分离制度。 The construction of the rule of exclusion of illegal criminal evidence is not only the need to protect human rights, but also the need to achieve judicial fairness and promote the reform of criminal investigation and the fight against crime.
