随着三维地籍物的出现,传统的基于二维的地籍系统已不能满足对于地上或地下空间利用登记管理的需要。该文首先引入“三维地籍形态”和“三维地籍物”的概念,并探讨二维宗地的空间权;然后分析其他国家在三维地籍形态中的相关权利规定和我国对三维地籍形态的相关规定;最后提出对我国三维地籍物确权登记的解决方案。
With the advent of three-dimensional cadastre, the traditional two-dimensional cadastre system has failed to meet the need for the use of registration management of above-ground or below-ground space. This paper first introduces the concept of “three-dimensional cadastral morphology” and “three-dimensional cadastre” and explores the spatial rights of two-dimensional parcels. Then it analyzes the related rights of other countries in the three-dimensional cadastre morphology and the related regulations of three-dimensional cadastre morphology Finally, the solution to the registration of the real right of the three-dimensional cadastral property in our country is put forward.
