完善的争端解决机制是保证实体规定得到充分实施的重要条件。由于世贸组织存在一个有效的争端解决体系,因此,通过《与贸易有关的知识产权协定》将知识产权问题纳入世贸组织,标志着知识产权权利保护新时代的到来。本文对世贸组织下与知识产权有关的争端解决问题进行初步探讨,并提出了自己的见解。
A sound dispute settlement mechanism is an important condition for ensuring that the substantive provisions are fully implemented. Due to the existence of an effective dispute settlement system in WTO, the incorporation of intellectual property issues into the WTO through the Agreement on Trade-Related Aspects of Intellectual Property Rights marks a new era in the protection of intellectual property rights. This article carries out a preliminary discussion on the issue of intellectual property-related dispute settlement under the WTO and puts forward my own opinions.
