中奖型电信诈骗是一类生活中常见且数量上呈现上升趋势的经济犯罪,着眼于经济学视角,被害人与犯罪人双方都具有经济人属性,其行为以期追求其自身利益的最大化。藉此,笔者认为治理此类犯罪可以从着眼被害人犯罪预防两方面着手。本文针对中奖型电信诈骗这一特殊的刑事犯罪,列举了其与一般电信犯罪的相同点与特异点,指出当下以打击犯罪人为主的治理措施存在的成本与收益不成正比的弊端,而后笔者立足于被害人犯罪防治,分析了当下我国阻碍被害人预防体系建立的一些不利因素,并在文章最后提出了对于预防犯罪的一些建议。
Winning telecom fraud is a kind of economic crime which is common and whose quantity is on the rise. Focusing on economics, both the victim and the perpetrator have economic attributes, and their behavior is to pursue the maximization of their own interests. By this, I believe that the treatment of such crimes can focus on crime prevention two aspects of victims. This article aims at the special criminal offense of winning the type of telecommunication fraud and lists the similarities and differences between it and the general telecommunication crime. It points out the shortcomings that the present cost and benefit are not proportional to the crime-based governance measures, In the prevention and treatment of victim crime, this article analyzes some unfavorable factors that hinder the establishment of victim prevention system in our country at the moment, and puts forward some suggestions on crime prevention at the end of the article.
