惩治腐败应强化用以实现一般预防的刑罚功能:宣扬刑罚惩治腐败一般威慑功能;注重刑罚惩治腐败法制教育功能;提高刑罚惩治腐败规范意识功能。同时,一般预防的实现有赖于整个刑事法律活动的开展,要使刑罚一般预防在揭露腐败现象,惩治腐败行为更好地发挥作用,有赖于一般预防刑罚必然性、及时性、公开性的实现。
To punish corruption, we should strengthen the penalties that are used to achieve general prevention: to promote penalty to punish the general deterrent function of corruption; to pay attention to punishing and punishing the function of education in corruption and legal system; and to improve punishment and punish the normative function of corruption. At the same time, the realization of general prevention relies on the development of criminal law as a whole. It is necessary for the general prevention of punishment to reveal the phenomenon of corruption and to punish corrupt behaviors in a better way. This depends on the prevention of the inevitability, timeliness and openness of the general penalty.
