1998年10月我国政府签署了联合国《公民权利和政治权利国际公约》,如今正待国家最高权力机关的批准。该公约明确规定了任何人不得被强迫自证其罪,由此引发了学界对沉默权问题的关注和探讨。由于我国刑事诉讼法却没有规定沉默权,沉默权的引入就成了广为探讨的话题。论证沉默权可否在中国实现,有必要先澄清沉默权的含义与由来,分析引入沉默权的必要性以及我国立法规定的现状,再来讨论沉默权在中国的实现问题。
In October 1998, the Chinese government signed the UN International Covenant on Civil and Political Rights and is now awaiting the approval of the highest authority of the country. The Convention clearly stipulates that no one shall be compelled to commit crimes of self-incrimination, which has caused the academic circles’ attention and discussion on the right to silence. Since China’s Criminal Procedure Law does not provide for the right to silence, the introduction of the right to silence has become a topic of much discussion. To demonstrate whether the right to silence can be realized in China, it is necessary to first clarify the meaning and origin of the right to silence, analyze the necessity of introducing the right to silence and the status quo of legislation in our country, and then discuss the realization of the right to silence in China.
