农地作为一种特殊的资源,对于不同的法律主体,其利益价值体现不同。农地征收法律关系的主体有:地方政府、农村基层组织、用地单位和被征地农民。在征收利益格局下,不同的法律主体表现出不同的利益倾向和选择。规范农地征收行为,实现制度创新,必须基于各类行为主体的不同的特征。无论三农问题还是新农村建设,都必须构筑以保护农民权益为基础的利益表达和参与机制,并在操作中拒绝形式主义,才能实现国家新农村建设的伟大战略。
As a special kind of resource, agricultural land has different interests and values for different legal subjects. The legal subjects of farmland collection include: local governments, grassroots organizations in rural areas, land-use units and land-expropriated farmers. Under the pattern of levying benefits, different legal subjects show different tendency of interests and choices. To regulate the collection of farmland and to achieve system innovation must be based on the different characteristics of various types of actors. Regardless of the issue of agriculture, rural areas and farmers or the construction of a new countryside, we must construct a mechanism of interest expression and participation based on the protection of peasants’ rights and interests and reject the formalism in our operations so as to achieve the great strategy of building a new national countryside.
