国际环境法,乃因国际环境问题而生,旨在全球范围内消解环境问题的扩散。约自19世纪30年代迄今,国际环境法历经近200年的发展业已形成规模庞大的法律体系。然而,环境问题的全球性扩张并未得以遏制,却更为深广地侵入人类生存的各个领域,形成法律与事实间“反向伴生性关系”中的“同构现象”。以历史现象学为视野的多维诊断,意欲探寻其内在矛盾之根由。
International environmental law is born out of international environmental problems and aims to eliminate the proliferation of environmental problems on a global scale. About the so far since the 1930s, international environmental law has formed a large-scale legal system after nearly 200 years of development. However, the global expansion of environmental problems has not been checked, but has been intruded into all fields of human existence more extensively, forming the phenomenon of “isomorphism ” between law and reality. Multidimensional diagnosis based on historical phenomenology is intended to explore the root causes of its internal contradictions.
