空白票据是随着市场经济的发展和信用制度的发达而产生的,但由于空白票据违反了票据的文义性、要式性等基本法律特征,各国立法起初并未承认空白票据的效力。但随着空白票据逐渐在商务交易中广泛运用,各国相继在立法上允许和承认空白票据。本文从空白票据的构成要件、效力以及我国空白票据制度的立法完善等几个方面对空白票据制度进行了探讨。
Blank notes originated with the development of market economy and the development of credit system. However, since blank notes violate the basic legal features such as the textuality and formality of bills, national legislation did not initially recognize the validity of blank notes. However, as blank bills are gradually being widely used in business transactions, all countries successively legislate to allow and recognize blank bills. This article discusses the blank bill system from several aspects such as the composition of the blank bill, effectiveness as well as the legislative improvement of the blank bill system in our country.
