《海洋法公约》第234条作为公约中唯一一条针对北极的条款,对北极海洋环境保护有重要意义,它赋予了沿海国制定国内法律和规章以保护北极海洋环境的权利,既承认了北极海域的特殊情况和对其进行保护的必要性,又承认了沿海国在保护北极海洋环境上的利益,但同时也存在着缺陷。为了使第234条能更好的适用,本文对该条文进行了分析,并简要指出其在实际适用过程中存在的问题。
Article 234 of the UNCLOS, as the only article of the convention that addresses the Arctic, is of great importance to the protection of the Arctic marine environment.
