在我国,二元的、倾斜性理论与制度设计无法真正保障劳动权。从理论基础看,社会分层、追求实质正义、二元经济结构、二元劳动力市场并不必然导致二元的、倾斜性法律保护。已有的倾斜性法律保护理论与制度产生了诸多问题,如重新陷入“身份”陷阱、诱发道德风险、提高社会成本、激化社会矛盾、损害资方利益、影响经济发展进程。而劳动权保障的理想出路是剔除二元、倾斜的保护思路,实行平等的、一元的法律保护机制,在理论层面,构建从身份到契约到权利、提高劳资双方合作协调能力,建立和谐劳动关系的理论。在制度层面,强化国家保护劳动权的能力,界定国家对劳动权干预的边界,建立一元化的就业制度和一元化的社会保障制度。
