本文从分析虚假广告的危害及成因出发,提出我国现行法律法规对有关虚假广告的管理存在的缺陷,针对这些不足之处,应该加强以下具体措施:1、明确界定虚假广告的定义;2、加大广告主应承担的法律责任;3、加大对虚假广告的惩罚力度;4、把网络广告纳入广告管理的范畴。通过加强虚假广告的管理,完善《广告法》,更好的为市场经济服务,这也是加入WTO之后社会主义经济建设发展的必然所需。
Based on the analysis of the harm and causes of false advertisements, this paper puts forward the defects of the current laws and regulations in our country on the management of false advertisements. In view of these shortcomings, the following concrete measures should be taken: 1. Define the definition of false advertisement; 2. Advertisers should bear the legal responsibility; 3, increase the penalties for false advertising; 4, the online advertising into the scope of advertising management. By strengthening the management of false advertisements, perfecting the “Advertising Law” and better serving the market economy, this is also an inevitable requirement for the development of socialist economy after the accession to the WTO.
