陪审制度是国家司法机关吸收非职业司法人员作为陪审员参加案件审判过程的一种诉讼制度 ,陪审制度的完善是当代中国司法制度改革的重要内容。要进一步加强人民陪审工作 ,使其充分发挥应有的作用 ,必须通过立法加以完善。首先在宪法上要明确规定实行人民陪审制度 ,其次在相应的法律中应对陪审制度适用范围 ,陪审方式 ,陪审员选任 ,陪审员权利和义务 ,陪审员的培训和管理等作出具体规定。
Jury system is a kind of litigation system that national judicial organs absorb non-professional judicial personnel as jurors to participate in the process of case trial. Perfection of jury system is an important part of the reform of judicial system in contemporary China. To further strengthen people’s jury work so that it can give full play to its due role, it must be perfected through legislation. First of all, it is necessary to explicitly stipulate the implementation of the people’s jury system in the constitution, and secondly, to deal with the application of the jury system, jury system, jury selection, jury rights and obligations, and jury training and management in the corresponding laws.
